Terms and Conditions of Use

01Who may use PEFY

• You must be at least 12 years old to register.
• If you are a minor, you need a parent or legal guardian’s consent before registering and using the platform.
• The information you give must be accurate, true and your own.
• One person, one account.
• Do not create additional accounts to get around a limit, a suspension, a ban or any other penalty.
• Accounts may not be bought, sold, transferred, lent, rented or shared.
• You are responsible for everything that happens under your account.
• If an account was created with false information, someone else’s information, or to evade a penalty, PEFY may suspend or close it immediately.

02Identity verification (KYC)

You must complete PEFY’s identity check before using the services that sit behind it.

• If the check does not pass, those services stay closed to you.
• PEFY may ask for more information to confirm identity, check accuracy or prevent fraud.
• Do not submit forged documents, someone else’s documents, or misleading information.

03Becoming a seller

• You must pass identity verification before you can sell.
• You must own the work, or hold a clear right to sell it.
• You are responsible for the copyright, trade marks and other intellectual property attached to what you sell.
• Describe the product accurately — file types, contents, formats, what the licence permits and what it limits.
• Do not overstate what a product is or does.
• PEFY may review a product before or after it goes live.
• Approval is not a warranty that the seller owns the copyright. PEFY may still investigate and act later.

04What may not be sold

You may not sell, upload, distribute or publish any of the following.

05Product review

PEFY may review anything uploaded or reported. Where there is reasonable suspicion that a product infringes copyright, breaks the law or breaches these terms, PEFY may:

• stop the product being sold;
• suspend downloads;
• suspend the account;
• freeze funds in the wallet;
• ask for documents or further evidence;
• trace where the work came from.

06Licences

PEFY issues three licences — Personal for private use, Commercial for earning work, and Extended for client work, agencies, brands and commercial production, within the scope the seller sets.

• A seller chooses which licences their product is offered under.
• A seller sets the price of each licence.
• What a buyer gets is what the licence they paid for grants.
• A buyer may not use the work beyond that licence.
• Buying a licence does not transfer ownership or copyright of the source files, unless the seller says so explicitly.
• A buyer may not resell, redistribute or republish the source files unless that licence expressly allows it.
• A purchased licence is permission to use, on the stated conditions — not a purchase of the seller’s intellectual property.

07Buying and downloading

• Once payment succeeds, you get the download under the licence you bought.
• That download stays available indefinitely, unless a legal or security reason requires access to be suspended.
• If the seller removes the product afterwards, buyers who already hold the licence keep their access.
• Removing a product does not end licences issued before it was removed.

08Refunds

A purchased licence cannot be cancelled or refunded, unless PEFY decides otherwise in a particular case or the law requires it.

Once you have downloaded a product you have received it, and these are not grounds for a refund:

• you do not like it;
• you changed your mind;
• you never used it;
• you dislike the format;
• it turned out not to suit you.

09Fees and seller earnings

• PEFY takes a platform fee of 30% of the sale.
• The seller receives the remaining 70%, after PEFY’s fee and any deduction the law or the payment system requires.
• Sales land in the Seller Wallet.
• You can withdraw as soon as a balance is withdrawable.
• Withdrawals may be paused where there is reasonable suspicion of fraud, chargebacks, copyright infringement, account misuse, unusual transactions or a breach of these terms.

10Freezing wallet funds

• Funds may be frozen while an account is under investigation for fraud, copyright infringement or a breach of these terms.
• A freeze may be temporary while the facts are established.
• Where a serious breach is established, PEFY may forfeit up to 100% of the funds concerned, in line with the facts, the harm caused and what the law permits.
• Those funds may go towards refunding the people harmed, compensating the harm, the cost of the investigation, or legal proceedings.
• Freezing or forfeiting funds does not prevent PEFY from taking further legal action.

11Copyright and intellectual property

• By listing, a seller warrants they hold the right to sell the work.
• If a third party claims infringement, the seller must cooperate with the investigation.
• PEFY may suspend the product and the account while it investigates.
• Where infringement is established, PEFY may remove the product, suspend or permanently ban the account, freeze or forfeit the related funds, provide information to the authorities where there is a legal basis, and take legal action.
• The seller is liable for the harm caused by selling infringing work.

12Prohibited conduct

You must not:

• create fake accounts or use someone else’s details;
• share an account, or open several to evade a penalty;
• steal work or infringe copyright;
• sell AI-generated work;
• sell work you have no right to, or sell deceptively;
• give false product information or forge proof of ownership;
• use the platform for fraud, money laundering or unlawful transactions;
• attack the platform, damage it, or use malware or hostile code;
• harvest or steal other users’ data;
• avoid PEFY’s fees, or evade a suspension or ban;
• give away or resell PEFY’s own products without the right to.

13Penalties

Penalties are chosen to match the seriousness of what happened. PEFY does not have to work through the levels in order.

• Level 1 — Warning: a notice and a requirement to fix it.
• Level 2 — Content removal: the offending product or content is taken down.
• Level 3 — Temporary suspension: the account is suspended for a set period.
• Level 4 — Permanent ban.
• Level 5 — Legal action, where the conduct is serious or caused harm.

14Banned accounts

• After a permanent ban you may not create a new account to return.
• Do not use your old details, someone else’s, or any other method to get around a ban.
• PEFY may look for links between a new account and a banned one.
• An account created to evade a ban may be closed immediately.

15PEFY’s responsibilities

• PEFY is a platform on which users publish and trade digital goods.
• Sellers are responsible for the accuracy of, and the rights in, what they sell.
• PEFY does not warrant that every product is free of infringement, review process notwithstanding.
• PEFY may review, suspend or remove content where that is necessary to protect the platform, its users or a rights holder.

16Changes to these terms

• PEFY may revise these terms to keep them in step with the service, the law, or platform safety.
• Material changes will be announced or notified by an appropriate means.
• Continuing to use PEFY after a new version takes effect means accepting it, unless the law says otherwise.

17Governing law

These terms are governed by and interpreted under the law of the Kingdom of Thailand. Disputes arising from use of PEFY follow the process Thai law provides.

18What you confirm when you register

Before an account is created you confirm each of the following. Pressing “Accept and create account” is your acceptance of these terms.

• I have read, understood and accept PEFY’s terms and conditions.
• The information I have given PEFY is true and is my own.
• I understand PEFY may verify my identity and related information.
• I understand that selling AI-generated work is prohibited on PEFY.
• I understand that infringement or fraud may lead to removal, a permanent ban, frozen or forfeited funds, and legal action.
• I understand PEFY takes a 30% platform fee on sales.
• I understand that a purchased licence is not refundable under PEFY’s terms.
• If I am a minor, I confirm I have my guardian’s consent.
